“Loja Dos Pereiras” and about our services and activities, this website is owned by José Pereira Distribuição, Lda., located at Rua Parque Empresarial de Larim, Pav. 11-12-13, 4730-581 Soutelo – Vila Verde, Portugal, with VAT 504434365.

1. APPLICATION

1.1 These General Terms and Conditions apply to all visitors to the Loja DosPereiras website, www.lojadospereiras.pt (hereinafter referred to as “Site” or “website”) and to any other transaction of a commercial nature carried out through the website’s online store.

Navigation on the website, as well as the purchase of any product through it, implies the acceptance of these General Conditions of Contract and Use by the User and the Costumer.

Website and the Contracts for the purchase of items through such website will be governed by Portuguese law. Any dispute arising from, or related to the use of the website or to such Contracts shall be subject to the jurisdiction of the Portuguese courts.
Before ordering any product on our website, please read these Terms carefully and print or save a copy for future reference.
José Pereira Distribuição, Lda. reserves the right to revise and change the General Terms and Conditions at any time without prior notice, being certain that they comply with the provisions of Decree-Law 24/2014, of 17-02, with the changes introduced by Law 47/2014, of 28-07.

The reproduction, transfer, distribution or storage of the website contents www.lojadospereiras.pt without prior written authorization granted by José Pereira Distribuição, Lda. is prohibited for purposes other than strictly personal use.

Every effort has been made to ensure that the information presented is free of typographical errors. Even so, if these occur, José Pereira Distribuição, Lda. will proceed with the respective correction as soon as possible. The obvious errors, such as price, calculation or typographical
errors in offers, promotions, folders, brochures, catalogues, order confirmations, invoices and other written declarations by José Pereira Distribuição, Lda. are not binding.

The photographs of the products presented on the website are illustrative only. As such, José Pereira Distribuição, Lda. recommends that the Costumer consult the detailed description of the product in order to obtain complete information about the respective characteristics, as well as request more precise information, if he so wishes.

3. OFFER AND AGREEMENT

3.1 The offers and promotions on the website do not imply any obligation. When completing your order on the website, you are making a binding offer to purchase the product(s). All orders are subject to acceptance by José Pereira Distribuição, Lda. and the agreement between you and José Pereira Distribuição, Lda. will only be formalized when José Pereira Distribuição, Lda. starts the fulfilment of the Contract. If the ordered products are no longer sold or there is a stockout, José Pereira Distribuição, Lda. will inform you of this fact and reject the order. If possible, we can substitute other products of similar nature and quality.

3.2 Prices shown are in Euros. The availability of the products presented on the website is limited to the available stock at any given time.

4. DELIVERY COSTS

Postage will be charged for delivery of the ordered products. There is no possibility to refuse delivery or the costs related to it. The delivery value is indicated on the website.

5. PRICES, PAYMENT

5.1 The applicable prices are the prices of the products displayed on the Site. All products contain price indication with VAT and excluding VAT in Euros. Delivery costs as well as all other additional costs are indicated separately on the website.

5.2 Payments can be made by:
a) by Bank Transfer
b) by PayPal
c) by ATM payments
d) by Visa and Mastercard
e) by MBWay

5.3 In some cases, José Pereira Distribuição, Lda. may restrict payment to Bank Transfer only.

5.4 Bank Transfer:

After placing your order, you will receive a confirmation email that includes DosPereiras’ bank information so that you can proceed with the transfer. After completing the transfer, please send an email to geral@dospereiras.com with proof or confirmation mentioning the order number. Bank information will be indicated at checkout on the website.
Your order will be processed as soon as we receive payment if you choose to transfer by bank transfer.

5.5 PayPal

After the order is completed, the payment procedure is initiated. After choosing this payment method, you will be redirected to the PayPal page where you can confirm the purchase.

5.6 ATM payment

After the order has been completed and the payment procedure has started, having chosen this payment method, the necessary references will be available to complete the payment.

5.7 Visa and Mastercard

After the order is completed, the payment procedure is initiated. After choosing this payment method, you will fulfil your card information to complete the purchase.

5.8 MBWay

After the order is completed, the payment procedure is initiated. After choosing this payment method, you will receive a payment confirmation request on your MBWay app account on your smartphone.

6. DISCOUNTS

6.1 The period of validity of the promotions presented, is present in all the product files, just click on “promotion info”, next to the promotion.

6.2 The promotional discounts will be made on the condition that the order is finalized by the User, through the “checkout” and paid until the end of the announced period.

6.3 Saving a product in the “shopping cart” does not guarantee its price or discount, if the provisions of the previous point are not fulfilled.

7. DELIVERY / COLLECTION

7.1 José Pereira Distribuição, Lda. will strive to inform you of the expected delivery dates soon after the order is completed., but the maximum delivery period will never exceed working 20 days.

7.2 The delivery period begins on the day the contract is signed, as provided for in Article 3.1., unless expressly agreed otherwise between the parties.

7.3 If any item is damaged or missing from your order, please contact us at +351 253145399 or email geral@dospereiras.com, within 5 days of delivery. If at the time of delivery any product is damaged, the carrier’s employee must be informed at the time of delivery and record it on the transport document. The product will be collected within 14 days from the day the Customer contacts us, unless otherwise agreed.

7.4 Products are delivered to the specified location at the time the order is placed. Ownership of the goods passes to the Customer with full payment of the price and any other amount. The risk of loss or damage to the goods is transferred to the Customer at the time of delivery.

7.5 The Products will be delivered (by a carrier) to the address provided by the Customer. If you choose to place your order in more than one order process, different delivery times may apply.

7.6 Delivery to the Mainland

7.6.1 Deliveries are made between 9:00 am and 6:30 pm and it is not possible to indicate the exact time of delivery. The day before the order is dispatched, you will receive an email with information about the shipping and delivery conditions. The products will only be delivered in person, and cannot be left at entrances, porches or other places outside the house.

7.7 Delivery to the Islands

7.7.1 As a rule, shipments are made by the carrier with which José Pereira Distribuição, Lda. works. Shipping costs are calculated on a case-by-case basis. Upon confirmation of the order, the Customer will be informed of the amount.

8. WARRANTY / CLAIMS

8.1 The Customer always has legal warranty rights for the equipment required by law, for a period of two years from the delivery of the product, under the terms and conditions of the law.

8.2 After reporting the defect, the Customer must allow José Pereira Distribuição, Lda. to analyze the Products. The inspection of the defective Product takes place at José Pereira Distribuição, Lda . The transportation / refund costs are borne by José Pereira Distribuição, Lda., unless the claim under the warranty is denied, in which case the Customer has to pay shipping costs.

8.3 Any defects in the Products that result from normal wear and tear or any other external cause, such as, but not limited to, damage by transportation by the Customer, misuse, or if the Customer has made any repairs to the product without prior written authorization José Pereira Distribuição, Lda., will not be covered by the warranty, unless such use or repairs are inherent in the use of the Products.

9. LIABILITY AND INDEMNITY

Article 4 of Decree-Law 24/2014, of 17-02, with the changes introduced by Law 47/2014, of 28-07.

9.1 The liability of José Pereira Distribuição, Lda. is limited, to the extent permitted by law. José Pereira Distribuição, Lda. will never be responsible for any damage to the Client if:
a) The damage results from non-compliance with the producer’s liability, unless José Pereira Distribuição, Lda. is legally responsible, under the terms of the law;
b) The first damages indirect and / or consequential damages.

9.2 In the event of damage, the Customer is obliged to limit, as far as reasonably possible, any additional or other damages.

10. RIGHT OF RETURN / RESOLUTION

Articles 4, 10 to 14 and 17 of Decree-Law 24/2014, of 17/02, with changes introduced by Law 47/2014, of 28-07.

10.1 The Costumer has the right to return the item within 14 days from the day the Customer or a third party on his behalf, acquires physical possession of the asset, or the last asset in the case of several goods ordered in a single order and delivered separately.

You can exercise the right of withdrawal to: José Pereira Distribuição, Lda., Rua Parque Empresarial de Larim, Pav. 11-12-13, 4730-581 Vila Verde, indicating the decision to return the article by unambiguous statement (for example, letter sent by post, e-mail), to be sent before the deadline referred to in the previous paragraph.

Resolution effects

If the Customer terminates the contract, we will reimburse all payments due, including delivery costs (with the exception of the extra costs due to the choice of a shipping type other than the cheapest standard shipping method provided by us), without undue delay and, whatever the case may be, within 14 days from the day we are informed of the decision to end that contract. We will proceed with the refund using the same payment method used in the initial transaction, unless it has been expressly agreed otherwise, within a maximum of 72 hours. In any case, the Customer does not incur any costs as a result of this payment. We reserve the right to withhold refunds until we have ordered the returned Products or until proof of shipment has been submitted, whichever is sooner.

Return of articles

If the Customer chooses to exercise the right of withdrawal, the cost of returning the goods is predetermined.

Liability and Warranty

José Pereira Distribuição, Lda. is not responsible for any inconvenience or damage caused by the use of the Internet network, such as: service disruption, external intrusion, anomalies caused by computer viruses or any other case of force majeure.

José Pereira Distribuição, Lda. does not assume damages caused by misuse of products and / or by adverse weather conditions.

Any order contract made on the Loja DosPereiras website can be resolved under the terms of article 6 of Decree-Law no. 143/2001 of 26 April. To this end, the user must return his order within a maximum period of 14 days from the date of receipt, by contacting our Customer Service through the customer area available on the website.

The return process varies depending on the source, so the User must contact José Pereira Distribuição, Lda. previously through the email address (geral@dospereiras.com) or through his Customer Support Service available on the website.

In case of resolution, the user must keep the goods in order to be able to return them to José Pereira Distribuição, Lda., in proper conditions of use, within 30 days of receiving the data.

José Pereira Distribuição, Lda. does not accept any return sent with postage to be paid or a counter refund, committing itself to refund the User within a maximum period of 30 days after receiving the return.

Returned products must be in a condition of sale, that is, in the same condition in which they arrived in the hands of the User, without any anomaly.
